LIVASTAR’S TERMS AND CONDITIONS FOR THE ACCEPTANCE OF PRIZES FOR “#DilwaleDubstar” CONTESTCONTEST: “Dilwale Dubstar” Contest is conducted by Livastar.com, having its registered office at Backlift Technologies Pvt Ltd, Vindhya - C4, IIIT-Hyderabad, Pin Code - 500032
Before participating in the contest please read the terms and conditions given here. CONTEST PERIOD:Entries for this contest must be received between 20:00:00 hrs on 11th December, 2015 and 20:00:00 on 13th December, 2015 (48 hours) and no later. After this no entries shall be entertained and summarily rejected.ELIGIBILITY: Participant MUST be a citizen of India residing in India, Mumbai and over 18 years of age. Residents of other countries and non-Indian citizens are not eligible to participate in this Contest. The employees, agents, associates and promoters of livastar.com and of its affiliate’s subsidiaries and advertisement agencies (including their immediate family members) and all others directly associated with organising this contest are not eligible to participate. No charges are payable to livastar.com or the organisers to participate in or win the contest. The contest is not being conducted with a view to earn profit or promote the business or sales of the promoting company.Entries may be submitted only according to the procedure described in these terms and conditions. Entry submitted through any other mode or platform shall not be entertained and summarily rejected. To participate in the contest, the participants must upload their video on Social Media and tag Livastar. All entries sent by the participant(s) would be received, monitored, verified, authenticated and stored by the agency in their computer systems. Entries sent by the participants which do not comply with these terms and conditions will be rejected. Livastar reserves the right at its sole discretion to disqualify any such entry at any time.Standard rules for the contest have been already decided by Livastar / its agency which shall be binding and non-contestable.
WINNER SELECTION Out of all the eligible correct entries, TEN winners will be selected as Prize Winners (“Prize Winners”) through judges’ discretion and computer aided randomized lucky draw technique organized by Agency. Selection of entries and assessment will be in the presence of the senior representatives of Livastar and/or the agency latest by 13th December, 2015.The Prize Winners will be notified at the same phone number or email as given in the Contest entry by the participants and available with Livastar or its agency. Livastar and its agents, affiliates and representatives will use their best efforts to contact the Prize Winners. The name of the Prize Winners will be announced on the Livastar Facebook Page (www.facebook.com/Livastar) and Twitter Handle (www.twitter.com/Livastar)In case the Prize Winners cannot be contacted even after two (2) attempted calls for 3 consecutive days (03) number of attempted calls within three (3) days from the date of declaration of the Prize or if the Prize Winners do not present themselves for collection of the Prize within 3 (three) days of announcement, the selected Prize Winner will stand disqualified and the next eligible Prize Winner shall be selected by the agency/ Livastar as the Prize Winner by adopting the same procedure of randomized lucky draw from the names/IT reference numbers/telephone numbers of all other eligible participants who have furnished correct answer(s).If any of the original Prize Winner/s, is disqualified for this or any other reason, such as being found ineligible or indulging in fraudulent practices or failing to comply with all these terms and conditions then the next eligible alternate Prize Winner/s will be entitled to the prize instead, according to the aforementioned selection procedures. Basis the judges’ discretion, top five winners will get a chance to Meet and Greet with the cast of Dilwale, while the rest are given signed merchandise as a prize.ACCEPTANCE OF PRIZEEach winner (hereinafter “the Winners”) of the “#DilwaleDubstar” Contest (hereinafter “the Promotion”), shall separately accept the prize, upon signature by the Winner of these unalterable standard terms and conditions, as proof of his/her unconditional acceptance hereof. Livastar will thereafter issue a confirmation of acceptance through Social Media, where after these terms and conditions shall commence operation. The Winner shall accept the prize upon signature of these unalterable terms and conditions, which are not negotiable, within 3 (three) Business Days (excluding Saturday, Sunday and official public holidays of India) from the date upon which the Winner has been announced, irrespective whether the Winner actually received knowledge thereof. Failure by the Winner to accept and sign these terms and conditions within the time period as stipulated above will result in the Prize being invalid.Prizes will be awarded to the Prize Winners after due verification and in accordance with the terms and conditions stated here and above. The Prize Winners shall prior to taking the Promotional offer, be required to submit to Livastar, valid ID proof (the copy submitted should be self-attested) as to Livastar satisfying all terms and conditions of prize, and other documents required by Livastar.Valid ID proof as well as residence proof, any one of the following may be submitted.a) Passport b) Voter Idc) Driving Licensed) UID/ Aadhar cardCOSTSLivastar shall only be liable for the costs of the prizes. All other costs, notwithstanding such additional costs being associated, directly or indirectly, with Livastar’s expenditure obligations, shall be for the sole account of the Winner.SPECIAL REQUESTSThe Winner must make all special request known in writing to Livastar. Livastar will endeavour to comply with the special requests, which will be for the cost of the Winner, but Livastar cannot guarantee that such requests will be met.CANCELLATION AND AMENDMENTSLivastar reserves the right to cancel at any time prior to event, without incurring any liability of whatsoever nature, howsoever arising, which may result from such cancellation. In the event of the Winner cancelling his/her Prize, such cancellation shall be made in writing and forwarded in advance to Livastar. No verbal cancellation will be accepted. Should the Winner cancel the Prize without prior written notice, Livastar reserves the right, to claim damages or any other remedies it may have in any law from the Winner, resulting from such late cancellation.DETAILS OF THE PRIZELivastar shall determine, in its sole discretion, all detail including the dates and times of the Prize, which LIVASTAR may amend at any time in its sole discretion. The itinerary of the Prize shall be available on request from LIVASTAR. The Winner’s refusal/ omission to strictly follow the contents of the itinerary shall be deemed a material breach of this Agreement, and LIVASTAR reserves the right to cancel this Agreement and claim damages and/ or any other remedies it may have in law. COSTS INCURRED FOR THE CONTESTThe said prizes, the cost and expenses incurred towards conducting and administering the contest as well as the expenditure incurred towards the advertisement are being borne by Livastar out of its own funds and the same are not being recouped in any way by the participants. PUBLICITY & PROMOTIONBy entering into the contest, and accepting the prize offer, the Prize Winner waives all copyrights, rights of publicity and any related rights and specifically consents to Livastar’s right to audio, videography, picture, tape or portray him/her as a Prize Winner and to exhibit this material in any and all media now existing or here and after created, including (without limitation) television, film, radio and print media without any compensation Livastar whatsoever for such advertising the publicity, except where prohibited by law, for a period of 5 years from the award of Prize.The Prize Winner also consents to Livastar’s unconditional right to use his/her name, voice or picture or the contents of his/her contest entry. The contest is not available (void) where prohibited by any law. All relevant national and local laws apply. All disputes to be settled within the jurisdiction of Courts in Mumbai (Maharashtra) only.RESPONSILBILITY AND LIABLITYThe Winner acknowledges that since LIVASTAR provides the opportunity for the Meet & Greet as an ex gratia prize, the Winner shall have no claims whatsoever against LIVASTAR arising from any action and/or omission, whether negligently or intentionally caused, by LIVASTAR or any of its service providers or agents, including cancellation of the passes and merchandize for any reason whatsoever.Without derogating from the general disclaimer above, it is acknowledged that LIVASTAR merely provides the opportunity of winning prizes and will endeavour to make the necessary arrangements to fulfill this claim. LIVASTAR shall not entertain complaints and/ or requests for compensation for any reason in cash or kind.Furthermore the Winner agrees that he/she engages in any physical exercise and/or activity voluntarily and absolutely at his/her own risk. The Winner assumes the sole risk of any and all injury, illness and/ or damage to the Winner’s, or any third party’s (including dependants), person and property that may occur.The Winner hereby indemnifies and holds LIVASTAR harmless against any and/or all claims of whatsoever nature, including injury to body or death, made against LIVASTAR by any person, from whatsoever cause arising, including any and third parties’ negligence and/ or intentional conduct or omission. The Winner hereby acknowledges that he/she understands fully that this clause is a disclaimer of all LIVASTAR’s liability.GENERALLivastar reserves the right to change the terms and conditions of this contest and to alter or terminate the contest at any time without prior notice.
